Acceptable Use Policy

 1.  About this Policy

1.1  This Acceptable Use Policy (AUP) applies to all Customers who use or acquire Services from our Site.

1.2  This AUP is in addition to our Terms and Conditions of Supply which will govern any supply of our Services and is available at our Site here: star2m.com/terms-conditions (Terms).

1.3  Capitalised terms defined in the Terms have the same meaning in this AUP.

1.4  In the event of a conflict between the Terms and this AUP, the Terms prevail.

1.5  The consequences of violation of this AUP are set out in section 11, and include the right for us to immediately terminate the provision of the Services.

2.  Changes

2.1  We may revise this AUP from time to time by posting a new version on the Site.

2.2  Any new version will be effective when posted on the Site. You will be deemed to have accepted any changes if you continue to use the Services after the effective date.

2.3  You are responsible for ensuring that the use of the Services complies with the most recent version of the AUP.

3.  Purchase of Services

3.1  All orders of Services on our Site are subject to our Terms.

Your continued use of the Site and the provision of your personal information constitutes your approval for us to deal with your personal information in accordance with this AUP and our Privacy Policy.

5.  Security

5.1  You are responsible for any misuse of the Services made available to you, even if the misuse was committed by another person or party with access to your Services, regardless of whether the misuse was with or without your consent.

5.2  The Services must not be used in any way:

(a)  to breach the security of another customer or to attempt to gain access to any other person's computer, mobile device, software or data, without the knowledge and consent of that person;

(b)  in any attempt to circumvent the security of any host, network or account of another person or party. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorised to access, or probing the security of other networks;

(c)  disrupt the Services of our, any of our Related Entities, the Network Operator or any of our supplier or contractor’s networks through which the Services are provided;

(d)  interfere with telecommunications services to any user, host or network;

(e)  transmit or disseminate spam or any information or software that contains a virus or other harmful feature.

6.  Illegal Activity

6.1  You must not use the Service for any activity that violates any local, state, federal or international law.

6.2  You are responsible for any illegal activities, even if committed by another person or party with access to your Services, regardless of whether the illegal or prohibited activity was with or without your consent.

6.3  Prohibited activities include, but are not limited to:

(a)  posting, disseminating, downloading, transmitting, storing or accessing material which is unlawful, abusive, misleading, obscene, defamatory or threatening or otherwise inappropriate materials;

(b)  disseminating material which violates the copyright or other intellectual property rights of others;

(c)  illegal selling or soliciting schemes;

(d)  any fraudulent activities.

7.  Unreasonable or Inappropriate Use

7.1  We consider your use of Services unreasonable if you use it in a manner which is other than it was intended for.

7.2  The Services must not be used to send unsolicited bulk or commercial messages. This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures and political or religious messages.

7.3  You may not use any equipment on the network which have not been approved in writing by us or our Related Entity.

7.4  You must ensure that your activity does not improperly restrict, inhibit, disrupt, degrade or impede our ability to provide the Services.

7.5  We reserve the right to monitor (and request Related Party Entity or the Network Operator to monitor) your bandwidth, usage or content, to identify violations of this AUP; and to protect the network and other customers.

8.  Inappropriate Content

8.1  There may be content otherwise available through the Services which may be offensive to some individuals, or inappropriate for children. We assume no responsibility for the content available through the Services. You assume the risk of accessing content through the Services, and we shall have no liability for any claims, losses, actions, damages, suits or proceedings arising out of or otherwise relating to access to such content.

8.2  You are solely responsible for any information which you disseminate or publish through the Service.

8.3  By using the Services to reproduce, publish, display, transmit or distribute content, you warrant that the content complies with this AUP and authorise us, (our Related Entities and authorised agents) to reproduce, publish, display, transmit and distribute such content as necessary for us to deliver the content in a timely manner.

9.  Links to other sites

9.1  You may be able, through hypertext or other links, to gain access to other websites operated either by us or our Related Entities (Linked Sites) or other third parties (Third Party Linked Sites).

9.2  The Linked Sites may have a different acceptable use policy.

9.3  Unless otherwise specified, the Third Party Linked Sites are not under our control and may have different acceptable use policy and may be subject to different laws. We are not responsible for the content of any Third Party Linked Sites. We provide these links for your convenience only. You link to any such Third Party Linked Sites at your own risk.

10.  Spam

10.1  Any publication of our email addresses on this Site is to facilitate communications relating to the Services. It must not be inferred as consent by us to receive unsolicited commercial electronic messages.

11.  Breach of the Acceptable Use Policy

11.1  If you breach this AUP we may contact you and, if appropriate, ask you to modify your use of the Services. If you do not modify your use of the Services, we may suspend or cancel the Services. We will use our best endeavours to notify you before we suspend or cancel the Services if it is reasonably possible to do so. Failure to do so, will not affect our ability to suspend or terminate. To the full extent permitted by law, we will not be held liable for any claim, loss or damage you may incur from the suspension or termination of the Services due to your breach of this AUP.

11.2  In certain circumstances such as illegality and non-ordinary use, we reserve the right to suspend or cancel your service immediately and without notice to you.
